The Supreme Court has sentenced a pro-democracy activist to prison on a two-year suspended sentence for attending a 2020 protest demanding justice for activist-in-exile Wanchalearm Satsaksit. 

Jutatip Sirikhan, along with Parit Chiwarak, who is currently out of the country, was charged with violation of the Emergency Decree for attending a 5 June 2020 protest, which called for justice for Wanchalearm as well as other victims of enforced disappearance, according to Thai Lawyers for Human Rights.

During the protest, Jutatip and other protesters read out the names of over 80 victims of enforced disappearance. She later faced an additional charge: failure to comply with an official order, as she refused to have her fingerprints taken.

She admitted to participating in the protest while insisting that she was not an organizer responsible for notifying the police. She also argued that the protest was held in an open-air venue where participants wore masks. It was also a peaceful assembly, in line with the rights and freedoms guaranteed in the Constitution.

On 12 September 2022, the Court found her guilty as charged, sentencing her to two months with a 10,000 baht fine for violating the Emergency Decree. She was also fined an additional 2,000 baht for disobeying an official order. She was given a two-year suspended sentence.

The Appeal Court later ruled to uphold the initial verdict.

On 3 September, the Supreme Court also upheld the verdict, sentencing her to two months and a 12,000 baht fine with a two-year suspension. According to the Supreme Court, Jutatip did not deny that she posted on her Facebook account an invitation for people to attend the protest.

She was the first one to give a speech and had also prepared images of several political refugees to display at the venue. The Court believed that she played a role in organizing the protest. As for failure to comply with an official order, Jutatip did not provide a valid reason to justify her action.
