The Constitutional Court has postponed its ruling on the case of Daranee Charnchoengsilpakul to 17 Oct, the Criminal Court told her lawyer Prawase Praphanukul yesterday.
The Constitutional Court was expected to give its ruling yesterday on whether the secret trial of Daranee was constitutional or not.
On 25 June 2009, Daranee made a complaint to the Court of First Instance that its order to hold her trial in secret under Article 177 of the Criminal Procedural Code, which concerns national security, was unconstitutional, and requested that it forward her complaint to the Constitutional Court and suspend the trial, but the court dismissed the complaint on that day.
On 9 Feb, the Appeals Court considered that to decide whether any law was constitutional or not fell under the jurisdiction of the Constitutional Court and this issue had never been considered before.
The Appeals Court repealed the verdict of 18 years’ imprisonment by Court of First Instance, and had it forward the complaint to the Constitutional Court.
