House Speaker Waan Muhamad Noor Matha has dismissed a motion proposed by Move Forward Party (MFP) MP Rangsiman Rome to review the resolution that prevents the renomination of a prime ministerial candidate.  According to Noor Matha, the parliament's legal team contends that a review would undermine the credibility of parliamentary resolutions.

During the parliamentary session to select a prime minister, MFP MP Rangsiman proposed an urgent motion to review a resolution of July 19, 2023 which involved an interpretation of parliamentary regulations.  At issue is whether Regulation 41, which states that if a motion has been proposed and rejected it cannot be proposed again, also includes the nomination of a PM candidate.

Rangsiman argued that the nomination of a Prime Minister is a process separate from the proposal of general motions, adding that the constitution does not prohibit the re-nomination of a former Prime Minister. As a result, he argued, the resolution of July 19 risks elevating the legal standing of parliamentary regulations above the constitution, a problematic precedent.

He further explained that legal experts have jointly signed a statement opposing the interpretation on the grounds that it is incorrect. He said many legal professors have stated that the complicated legal status of the resolution may hinder the teaching and understanding of constitutional law.

"Let’s get back to establishing the right foundation. You might not want Pita Limjaroenrat to be the Prime Minister, but we shouldn't go so far as to burn down the house just to chase out a single rat. Are we really going to destroy parliamentary principles and create a foundation like this?” the MP concluded before the Speaker of the Parliament muted his microphone.

Noor Matha said he gave Rangsiman an opportunity to clarify his stance but dismissed the motion because the parliamentary legal team advised agains revisiting the resolution out of concern that repeated reviews could lead to confusion and undermine trust in passed resolutions.
