House Speaker Wan Muhamad Noor Matha has issued an order to postpone the Prime Ministerial vote scheduled for July 27, following a suggestion from the parliamentary legal team to wait for the Constitutional Court's decision on the issue of repeated nominations

 

On Monday, the Ombudsman petitioned the Constitutional Court to consider and rule on the resolution of July 19, which prohibits repeated nominations. The resolution blocked the renomination of Move Forward Party leader Pita Limcharoenrat for the Prime Minister.

 

The resolution states that a PM candidate’s nomination is considered a motion and must comply with Rule 41 of the Parliament's Rules of Procedure, B.E. 2563, which specifies that ‘any motion that has been voted down is prohibited from being proposed again in the same parliamentary session.’  


The Ombudsman argues that this action has led the process of appointing the Prime Minister to deviate from what is specified in the Constitution. The Constitution already specifies the procedure for considering and approving the appointment of the Prime Minister under Article 159 in conjunction with Article 272. Therefore, the vote by Parliament conflicts with the Constitution.

 

The Ombudsman also requested the Constitution Court to suspend the election of PM.

 

The Speaker of the House stated that the Ombudsman suggested that that parliament postpone the PM election and wait for the Constitutional Court's ruling to avoid potential damage. He added that even though the Speaker has the authority to suspend or postpone a parliamentary session, the opinions of the parliament’s legal team must be considered.

 

The Speaker also mentioned another reason to postpone the session: birthday ceremonies for the King, which will be held at provincial halls in all provinces on July 28. Some Members of Parliament and Senators are concerned that they may not be able to attend a parliamentary meeting on July 27 since they must prepare for the ceremonies, potentially causing problems in reaching a quorum.
